Privacy Notice

Pursuant to the Federal Law for the Protection of Personal Information Held by Private Individuals, as published in the Federal Gazette on July 5, 2010, Promotora Sunset Beach Clubs S.A. de C.V. (hereinafter the “Liable Party”) publishes this Privacy Notice in virtue of the personal information that it will collect from you (hereinafter the “Owner”).

I. Identity and Domicile of the Liable Party. The Liable Party is a Mexican corporation duly organized under the laws of Mexico whose charter includes, among other purposes, the purchase and sale of memberships giving their holder the right to use, either for a limited or unlimited time, residential units and their related services forming part of, including in a specific but nonlimiting manner, hotels, residential and time-share condominium hotels, as well as buildings meant for tourism purposes; to obtain or grant loans, giving and receiving specific guarantees, issue obligations, accept, draw, endorse or back all types of Credit Titles, provide bonds or guarantees of any type, with respect to acquired obligations or Titles issued or accepted by third parties.

The Liable Party is domiciled at Kukulkan Boulevard Km. 10 Lot 13-B C.P. 77500, Hotel Zone, Cancun, Quintana Roo.

II. Personal information we collect. The information collected from the “Owner” is strictly of a personal nature (that is to say it is information serving to identify the Owner, such as name, nationality, place of birth, marital status, profession, e-mail, financial capacity), and at no time will any sensitive personal information be collected (such as information concerning the more intimate aspects of the Owner’s life or whose inappropriate use could give rise to discrimination or serious risks).

III. Purpose of collecting personal information. The information we collect and that provided by you directly will be used to provide better service and to keep you informed of new products and services related to your membership. By volunteering this personal information you expressly accept and authorize its use.

IV. Options and ways provided by the Liable Party to limit the use and disclosure of personal information. The Owner can limit the use and disclosure of his or her personal information by sending a written request to datospersonales@sunset.com.mx, indicating precisely what limitation is required.

V. Ways to access, correct, cancel or object. The Owner of the personal information may apply his or her “ARCO” rights to the Liable Party at any time by sending a request to that effect through our Department of Personal Information at the e-mail address datospersonales@sunset.com.mx, pursuant to Article 29 of the Federal Law for the Protection of Personal Information Held by Private Individuals.

Whether in such case or as indicated in paragraph IV, the Liable Party will have 20 business days to answer and provide any information by Reply e-mail, counted from the date on which it receives said request.

VI. Transfer of personal information. The Liable Party hereby informs the Owner that it will use the personal information the latter make available, only for the purpose of providing requested products and services and to give information regarding new services, in general, we do not share your personal information with third parties outside of our investment group.

The Liable Party will, in all cases, advise third parties of the content of this Privacy Notice.

VII. Modifications of the Privacy Notice. The Liable Party reserves the right to modify this Privacy Notice in any manner and promises to provide legal notice of such change to the Owner of the personal information by publishing the new text on our web page at www.royalsunset.com
